Electrician Fired for Drinking Wins $78k Compensation

A Spanish electrician who lost his job after being caught drinking beer while on the clock has walked away with a surprising legal victory, securing compensation of about $55,000 following a court ruling. The man had been observed consuming as much as three litres of beer during work hours, behaviour his employer argued justified his immediate dismissal.

The court, however, came to a different conclusion. Judges acknowledged that the worker had indeed been drinking, but they found the company failed to prove that the alcohol made him unfit to carry out his duties, particularly tasks involving driving or electrical work. Without evidence that his performance or safety was compromised, the dismissal was deemed unfair.

The ruling left the company with two choices, either reinstate the employee or pay him compensation. They opted for the payout, amounting to roughly €47,000, which converts to a little under A$78,000. The decision reflects the court’s view that, while the behaviour was inappropriate, the punishment imposed by the employer went beyond what was reasonable under Spanish labour law.

The case has sparked discussion across Spain and abroad about the boundaries between workplace misconduct and disproportionate disciplinary action. Critics argue the ruling sends the wrong message, suggesting workers might get away with drinking during their shift. Others point out that the judgement focused squarely on evidence, or the lack of it, regarding actual workplace impairment.

For the now‑compensated electrician, the outcome marks a complete reversal of fortune. What began as a disciplinary dispute over beer breaks ended with a legal win worth tens of thousands of dollars. While it is unlikely to prompt a cultural shift toward on‑the‑job drinking, the case does highlight how critical proper documentation and proof are when employers move to terminate staff.
